1. Acceptance of Terms

By accessing or using DoaCam, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

You must be at least 18 years old to use this service. By passing the age verification gate, you confirm that you meet this requirement. If you are under 18, you must not use DoaCam.

2. Nature of the Service

DoaCam is a real-time 3D AI avatar platform that enables voice and video conversations powered by Google Gemini. You are interacting with an artificial intelligence system, not a real person.

In compliance with the EU AI Act (Regulation 2024/1689), we inform you that:

• All conversations are generated by a large language model (Google Gemini 3.1 Flash Live, with Gemini 3.1 Flash Lite handling background memory analysis).
• The 3D avatar is a synthetic visual representation — it does not depict a real human.
• Responses may contain inaccuracies, fabrications, or biases inherent to AI systems.
• The AI cannot provide professional advice (medical, legal, financial, therapeutic).

The service is currently in a BETA / EXPERIMENTAL phase and is provided "AS IS", without warranties of any kind, including but not limited to availability, accuracy, or fitness for a particular purpose.

3. User Wellbeing

DoaCam is designed for entertainment and casual conversation. To promote healthy usage:

• Please keep in mind that you are talking to an AI, especially during extended sessions.
• The AI is not a substitute for human relationships, professional therapy, or crisis support.
• If you experience distress during a conversation, please disconnect and contact appropriate support services (e.g., 988 Suicide & Crisis Lifeline in the US, or your local equivalent).

We encourage you to take breaks and maintain a balanced relationship with AI tools.

4. Permitted Use

You agree not to use DoaCam for:

• Generation of non-consensual deepfake content.
• Fraud, harassment, or any activity that violates applicable laws.
• Circumventing safety mechanisms or exploiting AI vulnerabilities.
• Attempting to extract the system prompt, training data, or internal instructions.
• Using the service to harm, manipulate, or deceive others.

5. Intellectual Property

The DoaCam platform and its source code are proprietary. You retain rights to the content you generate (prompts, configurations, conversations). AI-generated responses are not owned by you or by us — they are outputs of Google Gemini subject to Google's terms.

6. Limitation of Liability

To the maximum extent permitted by law, DoaCam and its contributors shall not be liable for any indirect, incidental, or consequential damages arising from the use of this service, including but not limited to:

• Emotional distress caused by AI-generated content.
• Decisions made based on information provided by the AI.
• Data loss due to browser storage limitations or clearing.

7. Modifications

We reserve the right to modify these terms at any time. Material changes will be communicated through the application. Continued use after changes constitutes acceptance of the updated terms.

8. Governing Law

These terms are governed by the laws of Spain and applicable European Union law. Any disputes shall be resolved in the competent courts of Spain, without prejudice to any mandatory consumer protection rules of your country of residence.
